This policy covers the website getboutiquepos.com, our help and blog content, and material hosted through the BoutiquePOS service, including online stores and managed websites created for merchants. It is published by BoutiquePOS (legal entity details to be published).
Who owns the content on this site?
Unless a page says otherwise, BoutiquePOS or the people who licensed it to us own the copyright in everything on this site. That includes the text, guides and blog posts, page designs and layouts, illustrations, icons, photos, videos, the BoutiquePOS name and logo, and the BoutiquePOS software.
Third-party names and logos shown on the site belong to their owners. See our Disclaimer for more on trademarks.
How may I use our content?
You are welcome to:
- read, print or save pages for your own use, for example to share a guide with your shop staff;
- quote short passages in an article, review or social post, as long as you credit BoutiquePOS and link to the page;
- link to any page on our site.
Please do not, without our written permission:
- copy whole pages, guides or blog posts onto another website;
- reuse our designs, illustrations or images in your own marketing;
- present our content as your own or remove credits;
- use our name or logo in a way that suggests we endorse you.
To ask for permission, use the form on our contact page.
Who owns the content merchants upload?
Merchants keep ownership of the product photos, descriptions, logos and other content they add to BoutiquePOS and to their online store. They give us only the permissions we need to host and show that content. Merchants are responsible for having the rights to everything they upload. Copying another brand’s product photos or descriptions without permission may infringe copyright.
How do I report copyright infringement?
If you believe content on getboutiquepos.com, or in a store or website hosted through BoutiquePOS, copies your work without permission, send us a notice through the form on our contact page. Choose “Copyright” as the topic if it is offered, or write “Copyright notice” at the start of your message.
We follow a procedure based on the US Digital Millennium Copyright Act (DMCA), and we apply the same process to notices from the UAE, Pakistan and elsewhere. Your notice should include:
- your name, address, phone number and email address;
- a description of the copyrighted work you say has been infringed;
- the exact web address (URL) of the material you want removed, so we can find it;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them;
- your physical or electronic signature (typing your full name is enough).
Please be accurate. Under the DMCA, someone who knowingly makes a false claim that material is infringing can be liable for damages. If you are not sure whether the use is infringing, consider getting legal advice first.
What happens after you receive a notice?
- We confirm we received your notice, usually within one business day.
- If the notice is complete, we remove or disable access to the material promptly.
- If the material was uploaded by a merchant, we tell them, pass on a copy of the notice (with your contact details, so they can reach you), and explain how to send a counter-notice.
- If a notice is missing key details, we will ask you for them before we act.
How do I send a counter-notice?
If your content was removed and you believe that was a mistake, or that you have the right to use it, you can send a counter-notice through the form on our contact page. Include:
- your name, address, phone number and email address;
- a description of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification;
- a statement that you consent to the jurisdiction of the courts where your address is (or, if you are outside the United States, any place where BoutiquePOS may be found), and that you will accept service of legal process from the person who sent the original notice;
- your physical or electronic signature.
When we receive a valid counter-notice, we send a copy to the person who made the original notice. We may restore the material 10 to 14 business days later, unless they tell us they have started court action to stop the infringement.
Repeat infringers
We may suspend or close the accounts of merchants who repeatedly upload infringing content, as our Terms of Service allow.
Does this change my other legal rights?
No. This procedure is offered to make reports quick and fair. It does not take away any rights you or a merchant have under the copyright laws of the United States, the UAE (including Federal Decree-Law No. 38 of 2021 on Copyrights and Neighboring Rights) or Pakistan (the Copyright Ordinance 1962), or any other country.
