These terms are the agreement between you and BoutiquePOS (legal entity details to be published) for using the website at getboutiquepos.com and the hosted BoutiquePOS point-of-sale service. By creating an account, starting a trial or using the service, you agree to them. If you sign up for a business, you confirm you are allowed to accept these terms for that business.
Where your order form or a signed agreement says something different, the order form wins for that point.
What is BoutiquePOS?
BoutiquePOS is hosted point-of-sale software for boutiques and apparel shops. It runs in a web browser and a mobile app. It includes product and variant management, barcode labels, sales, returns and exchanges, stock across locations, purchasing, customer records, loyalty, reports and an online store generated from your catalog. Optional services include a managed custom website and a bundle with marketing tools.
We may improve, change or remove features over time. If we remove something central to the plan you pay for, we will tell you in advance.
How does the free trial work?
Every new account gets a [[trial]]-day free trial. You do not need to enter a card to start. When the trial ends, your account pauses until you choose a plan. Data you added during the trial is kept for 30 days after the trial ends, so you can pick a plan and carry on, or export what you entered.
How does billing work?
Subscriptions run month to month. You can choose to pay yearly instead, at the discount shown on the pricing page.
- Prices are shown on our pricing page in your country’s currency and in your order form. Taxes are added or included as stated for your country.
- Renewal: monthly plans renew each month and yearly plans renew each year, on the same date, until you cancel.
- Price changes: we will give you at least 30 days’ notice before a price change applies to your plan. The new price starts at your next renewal after that notice.
- Late payment: if a payment fails, we will tell you and try again. If it is still unpaid after 14 days, we may pause your account until it is paid. We never delete data because of a late payment without warning you first.
Refunds are covered by our Refund Policy.
How do I cancel?
You can cancel any month from your account settings or by contacting us. There is no long-term contract and no cancellation fee. When you cancel, your account stays active until the end of the period you have already paid for. After that it closes, and you have 30 days to export your data before it is deleted.
Who owns the data in my account?
You do. Your products, stock, sales, customers, staff and other records belong to you or your business. You give us permission to host, copy, process and display that data only as needed to run the service for you, provide support, keep backups and meet legal obligations.
You can export your data at any time from the app (for example products, customers and sales reports as spreadsheet files). We do not sell your data and we do not use your customers’ details for our own marketing. Our Privacy Policy explains how we handle personal data.
You are responsible for having the right to collect and use the personal data of your own customers and staff, and for telling them how you use it, under the privacy laws that apply to your shop.
What are your responsibilities?
- Keep your login details safe and use separate staff accounts with the right permissions.
- Give accurate account and billing details.
- Set up your own tax rates, receipt wording and prices correctly. BoutiquePOS is a tool; it does not decide what tax you owe or file returns for you.
- Keep your own copies of anything you must retain by law, using the export tools.
Payments you take from your customers
BoutiquePOS records payments; it does not process them. Card payments run through your own card processor or terminal, under your agreement with that provider. Wallets and apps such as JazzCash, Easypaisa or gift cards are recorded as payment methods. We do not store card numbers, and we are not responsible for your processor’s fees, holds, chargebacks or outages.
Acceptable use
You agree not to use BoutiquePOS to:
- break any law, including consumer protection, tax, export and privacy laws;
- sell illegal, counterfeit or stolen goods, or goods that infringe someone else’s trademark;
- send spam or unlawful marketing messages to your customers;
- upload malware, try to break into the service or other accounts, or probe our systems for weaknesses without our written permission;
- overload the service on purpose, scrape it, or resell access to it without an agreement with us;
- copy, reverse engineer or build a competing product from the service, except where the law allows this.
If you break these rules, we may suspend the affected account. Where we can, we will warn you first and give you a chance to fix the problem.
Is the service always available?
We work hard to keep BoutiquePOS running, and we keep daily backups. However, uptime is best effort. We do not promise a fixed uptime percentage and these terms do not include a service level agreement (SLA). Maintenance, updates, internet problems and third-party outages can cause downtime. We will try to schedule planned maintenance outside busy shop hours and announce it in advance.
Third-party services and integrations
The service can connect to other products, such as WooCommerce, your card processor, label printers or our API connector. Those products are run by other companies under their own terms. We are not responsible for them, and they may change or stop working with BoutiquePOS.
Managed websites and the bundle
If you order a managed website or the bundle, we design and look after the site as described in your order. You must provide accurate content and have the rights to any logos, photos and text you give us. Setup fees and refunds for this work are explained in the Refund Policy.
Our intellectual property
The BoutiquePOS software, website, designs, guides and brand belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the service for your business while your subscription is active. See our Copyright Policy for more.
Feedback
If you send us ideas or suggestions, we may use them to improve the service without paying you or owing you anything.
Warranties
We provide the service “as is” and “as available”. To the extent the law allows, we do not give any warranty that it will be error-free, uninterrupted or fit for a particular purpose beyond what these terms describe. Nothing in these terms removes rights you have under consumer protection laws that cannot be excluded, including those of the United Arab Emirates and Pakistan.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as lost profits, lost sales, lost goodwill or lost data that you could have restored from an export or backup;
- our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the event that caused the claim.
These limits do not apply where the law does not allow them to, for example liability for fraud, or for death or personal injury caused by negligence.
Indemnity
If someone brings a claim against us because of your data, the goods you sell or your breach of these terms or the law, you agree to cover our reasonable costs of dealing with that claim.
Suspension and termination
You may stop using the service at any time by cancelling. We may suspend or end your account if you seriously or repeatedly break these terms, if you do not pay, or if the law requires it. Unless the reason is illegal activity or a security risk, we will give you notice and a chance to export your data.
Governing law and disputes
These terms are governed by the laws of the place where the contracting BoutiquePOS entity is registered, to be stated in your order form. Before going to court, we both agree to try to settle any dispute in good faith by contacting each other and talking it through for at least 30 days. This does not take away any right you have as a consumer to bring a claim in your own country.
Changes to these terms
We may update these terms. We will change the “updated” date and, for significant changes, tell account holders by email or in the app at least 30 days before they apply. If you do not agree with a change, you can cancel before it takes effect.
General
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we have not given up the right to do so later. You may not transfer your account without our consent; we may transfer these terms as part of a merger or sale of our business.
How do I contact you?
Use the form on our contact page, or the Show email button on that page. We reply within one business day.
